Brexit: CE marking applies longer

2021-08-30 Despite Brexit: CE marking is valid longer, namely until 2023 – and thus 1 year longer than planned. This was announced by the British government a few days ago. The British government wants to give companies more time. Therefore, they can still use the CE marking in most cases until January 1, 2023.

UKCA in force since January 1, 2021

Originally, only the UKCA (UK Conformity Assessed) marking was to apply in the UK as early as January 1, 2022. And replace the CE marking of the EU. The UKCA marking, in force since January 1, 2021, is a new UK product marking used for goods placed on the market in the UK.

Exceptions to the UKCA

Different provisions apply to Northern Ireland. There, the UKCA marking alone cannot be used to place goods on the Northern Ireland market. There are also separate regulations for medical devices, rail interoperability, construction products and civil explosives.

Obligation to use the UKCA

For the sale of goods in the UK, the UKCA marking is required for most goods that previously bore the CE marking.

Companies must largely meet the same technical requirements as for CE marking. This also applies to conformity assessment procedures and to standards applied to demonstrate conformity.

Almost the same as CE

Also the same as CE marking: the conditions under which you can use the self-declaration of conformity for UKCA marking. This means that if you were allowed to self-declare conformity for CE marking, then you are usually allowed to do so for UKCA marking.

UKCA does not apply in the EU

In the EU, the UKCA marking is not recognized. For the sale of goods in the EU, products need a CE marking.
